1. NATURE OF SERVICES
Just Ask A Paralegal provides legal document preparation services and educational information for self-represented individuals. We assist clients with the preparation of legal forms and documents based solely upon information provided by the client.
We are not attorneys and do not provide legal advice, legal opinions, legal representation, legal strategy, or legal recommendations.
The client is solely responsible for determining what services they need. The client directs the work to be performed, and Just Ask A Paralegal prepares documents based upon the information and instructions provided by the client.
2. NO ATTORNEY-CLIENT RELATIONSHIP
Use of this website or any services provided by Just Ask A Paralegal does not create an attorney-client relationship.
Communications with Just Ask A Paralegal are not protected by attorney-client privilege.
Clients should not rely upon Just Ask A Paralegal for legal advice and are encouraged to consult with a licensed attorney regarding legal rights, remedies, defenses, or strategies.
3. CLIENT RESPONSIBILITIES
The client agrees to:
• Provide complete, accurate, and truthful information.
• Respond promptly to requests for information or clarification.
• Carefully review all documents prepared by Just Ask A Paralegal.
• Verify the accuracy of all names, addresses, dates, financial information, case information, and other facts contained in prepared documents before filing or signing.
• Sign and file documents when required.
• Attend all court hearings, mediation sessions, conferences, or other proceedings when required by the court.
The client understands that Just Ask A Paralegal relies entirely upon information provided by the client and does not independently verify the accuracy of such information.
4. COURT APPEARANCES
Just Ask A Paralegal does not appear in court on behalf of clients and does not represent clients in any legal proceeding.
If a court requires a client to appear for a hearing, conference, mediation, settlement conference, trial, or any other proceeding, the client is solely responsible for attending and participating.
Failure to appear may result in adverse consequences, including dismissal of requests, entry of orders, sanctions, or other court actions.
5. REVIEW OF DOCUMENTS
Before any document is filed, served, signed, or submitted, the client must carefully review the document for accuracy and completeness.
Submission of a document to the client constitutes confirmation that the client has the opportunity to review and approve the document before filing.
The client assumes full responsibility for the contents of any document filed with a court or government agency.
6. REJECTED OR DEFECTIVE FILINGS
Just Ask A Paralegal is not responsible for court rejections caused by:
• Incomplete information provided by the client.
• Incorrect information provided by the client.
• Failure of the client to provide required supporting documentation.
• Changes in court procedures or filing requirements.
• Court clerk errors.
• Judicial decisions or rulings.
If documents must be revised or re-prepared because the client provided inaccurate, incomplete, or incorrect information, additional fees may apply.
The client shall be responsible for the cost of preparing replacements or corrected documents.
7. FEES AND PAYMENTS
All fees are charged for document preparation services only unless otherwise stated.
Court filing fees, service of process fees, recording fees, mediation fees, attorney fees, investigator fees, and other third-party costs are separate and are the sole responsibility of the client.
Payment is due as specified at the time services are purchased.
8. NO GUARANTEE OF RESULTS
Just Ask A Paralegal makes no guarantee regarding:
• Court approval of documents.
• The outcome of any legal matter.
• Entry of judgments or orders.
• Acceptance of agreements by opposing parties.
• The actions or decisions of judges, commissioners, court clerks, or government agencies.
Every case is unique, and outcomes depend upon facts, evidence, court procedures, and decisions beyond our control.
9. REFUND POLICY
Due to the nature of document preparation services, no refunds will be granted once work has begun or documents have been prepared.
Once documents have been drafted, prepared, reviewed, or delivered to the client, all fees paid are considered earned and non-refundable.
No refunds will be provided because:
• A client changes their mind.
• A client decides not to proceed.
• A client obtains an attorney.
• A court requests revisions.
• A court requires a hearing.
• An opposing party contests the matter.
• A client fails to complete the process.
10. CONTESTED MATTERS
Just Ask A Paralegal primarily assists with uncontested legal matters and document preparation.
If a matter becomes contested or requires legal advice, litigation strategy, legal representation, discovery, trial preparation, or courtroom advocacy, Just Ask A Paralegal may be unable to continue assisting with the matter.
No refund shall be provided if services are discontinued due to the matter becoming contested.
11. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Just Ask A Paralegal shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:
• Use of this website.
• Reliance upon information contained on this website.
• Errors resulting from information provided by the client.
• Court rulings or decisions.
• Delays caused by courts or third parties.
• Rejected filings.
• Loss of legal rights resulting from missed deadlines or client inaction.
12. WEBSITE CONTENT
Information provided on this website is for general educational and informational purposes only.
Nothing on this website should be interpreted as legal advice or as creating any legal relationship between Just Ask A Paralegal and any visitor.
13. CHANGES TO TERMS
Just Ask A Paralegal reserves the right to modify these Terms and Conditions at any time. Continued use of the website or services after changes are posted constitutes acceptance of the revised Terms and Conditions.
14. DISPUTE RESOLUTION – MEDIATION AND BINDING ARBITRATION
The parties agree that any dispute, claim, controversy, or disagreement arising out of or relating to the use of this website, the services provided by Just Ask A Paralegal, the preparation of documents, fees charged, or these Terms and Conditions shall first be submitted to mediation.
The parties shall attempt in good faith to resolve the dispute through mediation conducted by a mutually agreed-upon mediator located in California. Each party shall bear its own costs and share equally the mediator's fees.
If the dispute is not resolved through mediation within sixty (60) days after a written request for mediation is made, the dispute shall be submitted to final and binding arbitration.
The arbitration shall be conducted in the State of California before a single neutral arbitrator pursuant to the rules of the American Arbitration Association (AAA) or another mutually agreed arbitration provider. The arbitrator shall have the authority to award any remedy available under applicable law.
The parties understand and agree that by agreeing to arbitration, they are waiving their right to a trial before a judge or jury.
The arbitration decision shall be final and binding upon the parties and may be entered as a judgment in any court having jurisdiction.
This provision shall not prevent Just Ask A Paralegal from pursuing collection actions for unpaid fees in a court of competent jurisdiction, including Small Claims Court where permitted by law.
15. LIMITATION ON CLAIMS
Any claim arising out of or relating to services provided by Just Ask A Paralegal must be brought within one (1) year from the date the claim arose or such claim shall be forever barred to the fullest extent permitted by law.
16. GOVERNING LAW
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the State of California without regard to conflict of law principles.
